Terms of Service

Welcome to Chef Kong! These Terms of Service (“Terms”) govern your use of the Chef Kong meal planning application (the “App”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.


1. About Chef Kong

Chef Kong is a meal planning app provided by an individual developer based in Germany (referred to as “we”, “us”, or “our”). We license the App to you for personal, non-commercial use on compatible devices that you own or control, in accordance with Apple’s App Store terms and other applicable platform rules. The App and all content provided through it are owned by us or our licensors and protected by intellectual property laws.


2. Eligibility

You must be at least 16 years old to use Chef Kong. The App is not intended for children or anyone under the age of 16. We do not knowingly collect personal information from children under 16 years of age. If you are under the age of majority in your jurisdiction (for example, under 18 in many countries), you should use the App only with the permission and supervision of a parent or legal guardian. By using the App, you represent that you meet these eligibility requirements.


3. User Accounts and Sign-In

To access certain features, you may need to create a Chef Kong account. You can sign up using approved methods such as “Sign in with Apple.” **Account Security:** You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please use a strong password (if applicable) and restrict access to your device. Notify us immediately at our contact email if you suspect any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.


4. Payments and Subscriptions

Chef Kong may offer premium features or subscription plans for additional meal planning services. Any purchases (such as subscriptions or one-time fees) are handled through the Apple App Store (or other platform storefronts, if applicable). This means:

  • Billing: All payments will be processed by the App Store using the payment method linked to your store account. We do not collect or store your credit card or billing details.
  • Subscriptions: If the App includes auto-renewing subscriptions, they will renew automatically unless you cancel at least 24 hours before the end of the current period. Subscription management (including cancellations and refunds) is governed by Apple’s App Store policies. You can cancel or manage your subscription at any time through your App Store account settings. We are not able to cancel subscriptions or issue refunds on your behalf, as those are controlled by the App Store’s terms and procedures.
  • Free Trials & Offers: Any free trial periods or introductory offers will also be subject to the App Store’s terms. If you do not want to continue with a paid subscription after a trial, be sure to cancel in your App Store account before the trial ends to avoid being charged.

5. Use of the App

You agree to use Chef Kong only for its intended purpose of personal meal planning and related content. When using the App, you must not:

  • Violate any applicable laws or regulations.
  • Engage in unauthorized or harmful behavior – for example, attempting to hack, reverse engineer, or disrupt the App or its servers.
  • Use the App to distribute inappropriate, unlawful, or infringing content.
  • Impersonate any person or entity, or misrepresent your identity.

If you violate these rules, we may suspend or terminate your access to the App (see Section 9 on Termination).


6. User Responsibilities and Health Disclaimer

Meal Information: Chef Kong may provide recipes, meal plans, nutritional information, or other health-related content. While we strive to provide helpful and accurate information, **all such content is for informational purposes only**. **No Professional Advice:** The App is not a substitute for professional medical or nutritional advice. We are **not a medical or healthcare provider**. Always consult a physician, dietitian, or qualified health professional before making any significant changes to your diet or if you have specific health concerns. You acknowledge that no aspect of the App’s content constitutes medical or dietary advice or diagnosis for any individual’s particular situation.

Your Own Judgment: You are responsible for how you use the information provided by Chef Kong. Any action you take based on recipes or recommendations in the App is at your own risk. You should verify that ingredients and recipes are suitable for you (for example, checking for allergens, dietary restrictions, or health conditions). Use proper cooking techniques and food safety measures when preparing meals. **We do not guarantee** that any recipe is safe, accurate, or will meet your dietary needs, and we will not be liable for any illness, injury, or damages that may result from your preparation or consumption of foods from recipes in the App.


7. User-Provided Content

Chef Kong may allow you to input or store your own content such as personal recipes, meal preferences, or dietary notes (collectively, “User Content”). You retain any intellectual property rights that you hold in your User Content. By storing or uploading User Content in the App, you grant us a non-exclusive, worldwide, royalty-free license to use, host, and process that content solely for the purpose of providing and improving the service to you (for example, to save your meal plans across devices or to analyze preferences for better recommendations). You promise that you have the right to provide any content that you upload and that such content will not violate any laws or infringe anyone’s rights.


8. Intellectual Property

Our Content: All software, code, design, graphics, logos (including the “Chef Kong” name and logo), and other materials in the App are our property or licensed to us. They are protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, modify, or create derivative works of any part of the App’s content **unless** expressly permitted by us in writing. You are granted a limited, revocable license to use the App and its content for your personal use only, in accordance with these Terms.

Feedback: If you choose to provide feedback or suggestions to us about the App, you agree that we can use and implement that feedback without restriction or compensation to you. This helps us improve Chef Kong for all users.


9. Third-Party Services and Links

The App might integrate or link to third-party services or content (for example, recipe databases, social media sharing, or external websites for ingredients). These third-party services are not under our control, and we are not responsible for their content, accuracy, or availability. If you access third-party links or services through Chef Kong, you do so at your own risk. **Third-Party Terms:** Your use of any third-party service will be governed by that third party’s own terms and privacy policy. We do not endorse any third-party services, and any interaction you have with such services is solely between you and the third party.


10. Privacy

Your privacy is very important to us. Our collection and use of personal information in the App is described in our Privacy Policy (see below). By using Chef Kong, you also agree to the terms of the Privacy Policy. Please read it carefully to understand how we handle your data.


11. Disclaimer of Warranties

Chef Kong is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, regarding the App and its content. This includes but is not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or secure. For example, we do not warrant that the meal plans will meet your expectations or that any nutritional information is completely accurate. You assume all risk for any use of the App.


12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) Chef Kong or any content within it. This includes, for example, damages for lost profits, lost data, personal injury, or health issues, even if we have been advised of the possibility of such damages. We are not responsible for any harm to your mobile device or loss of data that may result from your use of the App (we recommend you back up data regularly).

In jurisdictions that do not allow the exclusion or limitation of certain liabilities, our liability will be limited to the fullest extent allowed by law. **Nothing in these Terms limits or excludes our liability for gross negligence, intentional misconduct, or any other liability that cannot be limited by law.** Your statutory rights as a consumer (if applicable) are not affected.


13. Termination

You are free to stop using Chef Kong at any time. You may also delete your account (if account deletion is available in-app) or request account deletion by contacting us. We reserve the right to suspend or terminate your access to the App at any time, **with or without notice**, if we reasonably believe: (a) you have violated these Terms or any applicable law; (b) you create risk or possible legal exposure for us; or (c) our provision of the App to you is no longer commercially viable. We will make efforts to notify you via the email associated with your account in such cases.

Upon termination, your right to use the App will cease immediately. If your account is terminated or you delete your account, we will handle your personal data in accordance with our Privacy Policy (for example, deleting or anonymizing your data, subject to any legal retention requirements).


14. Changes to These Terms

We may occasionally update or modify these Terms. For example, this could happen to reflect changes in our services, adapt to new legal requirements, or incorporate new policies. When we make material changes, we will notify users by (for instance) posting a notice in the App or updating the “last updated” date on these Terms. **Continued use of Chef Kong after changes** indicates your acceptance of the new Terms. If you do not agree to the revised Terms, you should stop using the App.


15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Germany, without regard to its conflict of laws principles. If you are a consumer located in the European Union, you may also be entitled to the protection of the mandatory consumer protection provisions of your country of residence. In the event of any dispute or claim arising out of or in connection with these Terms or your use of the App, we encourage you to contact us first to seek an amicable resolution. If we cannot resolve the dispute informally, any legal proceedings shall be brought in the competent courts of Germany (unless otherwise required by applicable consumer laws).


16. Miscellaneous

Entire Agreement: These Terms (along with the Privacy Policy) constitute the entire agreement between you and us regarding Chef Kong, and supersede any prior agreements or understandings related to the App. Waiver and Severability: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Transfer: You may not assign or transfer these Terms or your account to anyone without our written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets.

No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights. The agreement is between you and us only.
